Amin (claimant/appellant) v The Secretary of State for the Home Department (defendant/respondent)
Thursday 24 March 2022
The Appellant appeals the order of Richard Clayton QC sitting as a Deputy High Court Judge on 17 June 2021 by which he dismissed the Appellant’s judicial review claim.
The Appellant sought to challenge the SSHD’s decision of 14 January 2019, upheld on reconsideration on 02 April 2020, to refuse his application to naturalise as a British citizen. The refusal was based on the Appellant’s character and, in particular, his association with known members of Ansar Al Islam and his relationship with Mullar Krekar. The Appellant had visited Mr Krekar a number of times and had been married to his daughter. He refused to consent to a divorce when she requested a divorce. He has since remarried and has children in the UK. The Appellant had been arrested together with members of his household in 2005 but was released without charge and later received compensation for his detention.
