The Claimant appeals against the order made by Sir Andrew Nicol dated 15/11/21 striking out the amended particulars of claim as an abuse of process, and entering judgment for the Defendant.

The claim was brought over an allegation of guilt of crimes against humanity made by British Government in a Home Office Report published to at least several thousand people.

C submits that the judge’s finding that the claim would bring the administration of justice into disrepute and was therefore a Hunter-type abuse was wrong as a matter of law and principle as it relied on the judgment of a foreign criminal court.
