The father appeals the decision of Roberts J, sitting in the High Court of Justice, Family Division, by which she: 1) dismissed his application for disclosure of the material submitted in support of the child’s asylum application and 2) dismissed his application for the child’s summary return to the Ukraine and set aside the orders requiring the child’s return.
The child was granted asylum in the UK, following a claim made in October 2020. The father’s application for disclosure of the material submitted in support of the asylum application was dismissed by Roberts J’s order and is the subject of the present proceedings.
The brief background is Theis J on 7 May 2019 and Mr Robert Peel QC (as he then was) on 26 June 2020 both ordered that the child be returned to the Ukraine forthwith, however both times the mother failed to comply. The mother’s application for permission to appeal the order of Mr Peel QC was refused by Moylan LJ on 3 August 2020. The mother’s application for permission to appeal the refusal to return her travel documents was refused by Moylan LJ on 7 May 2021.
