Second appeal. Refusal of Leave To Remain as Tier 1 Entrepreneur. She had entered as a student in 2009 and then  sought the latter further leave. Leave was refused under paragraph  322(1A) on the basis that  she had submitted false bank  documents.

The First Tier Tribunal allowed the appeal. The SSHD reconsidered the application and again refused it for the same reasons. The applicant could not therefore show the required access to funds.

The FTT then dismissed the appeal finding that the bank documents were false. The applicant sought permission to appeal on the basis that the FTT’s original decision should not have been departed from.

The UT dismissed the appeal finding no error of law.
